How to structure contract disputes, arbitral jurisdiction and cross-border enforcement

These disputes are rarely only about contract interpretation. Contract text, performance facts, evidence language, arbitration clauses, asset location and enforcement path all matter.

Key Assessment

Check whether the arbitration clause is valid, whether the dispute falls within its scope, whether the signatory had authority, and whether place of performance or asset location affects enforcement.

Document Preparation

Contracts, supplements, orders, invoices, payment flows, bills of lading or logistics documents, English emails, meeting minutes, breach notices, foreign entity records and asset clues.

Procedure Path

Assess jurisdiction and evidence language first, then decide preservation, arbitration filing, counterclaims, expert opinions, overseas service or recognition and enforcement arrangements.

Risk Note

Do not prepare the matter only as a domestic lawsuit. Cross-border arbitration depends heavily on contract text, English evidence consistency, procedural timing and enforceability.
